Terms of Service

These Terms of Service (“Terms”) govern your use of AsbestoPlan (the “Service”), operated by CDM Marketing Ltd, trading as AsbestoPlan, a company registered in England & Wales (company number 14010841), registered address 34 Clarence Street, Southend-on-Sea, England, SS1 1BD. By creating an account or using the Service you agree to these Terms.

1. The Service

AsbestoPlan is a professional planning support tool for creating, editing and exporting visual asbestos enclosure plans. It is provided on a subscription basis. It is not a regulated compliance system — see our Disclaimer, including the section on generic asset library representations.

2. Accounts

You must provide accurate registration details and keep your login credentials secure. You are responsible for all activity under your account. You must be at least 18 and using the Service for business or professional purposes.

3. Subscriptions, billing and trials

  • Paid plans are billed in advance on a recurring basis (monthly or annually) through our payment processor, Stripe.
  • The free Preview plan is available at no cost and does not require a payment card. Paid plans may start with a free trial of the stated length; a payment card is collected at checkout, and unless you cancel before the trial ends your subscription starts automatically and the applicable fee is charged.
  • Subscriptions renew automatically at the end of each billing period until cancelled.
  • Prices are shown in GBP. We are not currently VAT-registered, so no VAT is added.
  • We may change pricing on renewal by giving you reasonable advance notice.

4. Cancellation and refunds

  • You can cancel at any time from the Billing page. Cancellation stops future renewals; your plan stays active until the end of the current paid period.
  • Except where required by law, fees already paid are non-refundable and we do not provide partial refunds for unused time. Statutory cancellation rights under the Consumer Contracts Regulations 2013 may still apply to consumers.

Optional AI drawing credits

Where enabled for your workspace, AI credits pay for generating drawings and edits, including interpreting an uploaded plan to create a drawing. Ordinary Chat questions, explanations, editor help and public website Chat do not use your credits. Free help still has reasonable service-capacity and abuse limits.

We show the credit cost before a chargeable request. One completed, saved drawing result or preview is charged once, whether you apply it or leave it unapplied. Failed requests and clarification-only answers do not use customer credits. Applying a saved result, editing manually, Undo and Redo do not incur another AI charge; undoing a successfully delivered result does not automatically refund its original charge. Contact support if a charged result could not be used.

Credits belong to the workspace shown before you spend. Company credits are shared under that workspace's member limits and may fund an authorised member's personal drawing when that workspace is selected as payer. Buying credits does not add seats, unlock a feature or change the owner of a drawing. Only the authorised payer can buy a pack. The pack's credit amount and final GBP price are shown before payment; we are not currently VAT-registered and no VAT is added. Top-ups are one-off purchases, not automatic repeat charges.

Purchased credits carry forward without automatic expiry. Included monthly credits, where offered by your plan, expire at the end of their stated period and are used before purchased credits. Credits are not money and cannot be transferred between workspaces. Your subscription and feature permissions still apply after a downgrade. A top-up does not remove provider availability, rate, safety or fair-use limits; if capacity prevents a request from completing, we do not charge customer credits for that request.

For a refund or payment query, contact support@asbestoplan.co.uk with the purchase reference. An approved payment refund reverses the corresponding credits. If those credits have already been spent, or a payment is disputed, credit purchases and spending may be held for review. This does not itself cancel your subscription or prevent manual drawing. These rules do not exclude statutory cancellation rights or remedies for faulty services. We do not treat buying a pack as a waiver of any consumer cancellation right.

5. Acceptable use

You agree not to:

  • use the Service unlawfully or in breach of these Terms;
  • attempt to gain unauthorised access to, or disrupt, the Service or its systems;
  • reverse engineer, resell or copy the Service except as permitted by law;
  • upload content that is unlawful, infringing or malicious.

6. Your content

You retain ownership of the project data and content you create. You grant us a limited licence to host and process that content solely to provide the Service. You are responsible for the accuracy of any data you enter and for any decisions made on the basis of the visual output.

7. Intellectual property

The Service, including its software, design and content (excluding your content), is owned by CDM Marketing Ltd and its licensors and is protected by intellectual property laws.

8. Limitations and disclaimer

The Service is provided “as is”. AsbestoPlan is not HSE-approved or compliance certified. Final enclosure design, risk assessment, method statement, plan of work and statutory compliance remain the responsibility of competent asbestos professionals and, where required, licensed asbestos contractors. To the fullest extent permitted by law, we exclude liability for indirect or consequential losses, and our total liability arising from the Service is limited to the fees you paid in the 12 months before the claim. Nothing in these Terms limits liability that cannot lawfully be limited (such as for death or personal injury caused by negligence, or fraud).

9. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms. You may stop using the Service and delete your account at any time from your Account & privacy page.

10. Changes

We may update these Terms as the product evolves. We will update the date above and, where changes are material, notify you. Continued use after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction, save that consumers may benefit from mandatory protections of their country of residence.
