Terms of Service

These Terms of Service (“Terms”) govern your use of AsbestoPlan (the “Service”), operated by CDM Marketing Ltd, trading as AsbestoPlan, a company registered in England & Wales (company number 14010841), registered address 34 Clarence Street, Southend-on-Sea, England, SS1 1BD. By creating an account or using the Service you agree to these Terms.
1. The Service
AsbestoPlan is a professional planning support tool for creating, editing and exporting visual asbestos enclosure plans. It is provided on a subscription basis. It is not a regulated compliance system — see our Disclaimer, including the section on generic asset library representations.
2. Accounts
You must provide accurate registration details and keep your login credentials secure. You are responsible for all activity under your account. You must be at least 18 and using the Service for business or professional purposes.
3. Subscriptions, billing and trials
- Paid plans are billed in advance on a recurring basis (monthly or annually) through our payment processor, Stripe.
- The free Preview plan is available at no cost and does not require a payment card. Paid plans may start with a free trial of the stated length; a payment card is collected at checkout, and unless you cancel before the trial ends your subscription starts automatically and the applicable fee is charged.
- Subscriptions renew automatically at the end of each billing period until cancelled.
- Prices are shown in GBP. We are not currently VAT-registered, so no VAT is added.
- We may change pricing on renewal by giving you reasonable advance notice.
4. Cancellation and refunds
- You can cancel at any time from the Billing page. Cancellation stops future renewals; your plan stays active until the end of the current paid period.
- Except where required by law, fees already paid are non-refundable and we do not provide partial refunds for unused time. Statutory cancellation rights under the Consumer Contracts Regulations 2013 may still apply to consumers.
5. Acceptable use
You agree not to:
- use the Service unlawfully or in breach of these Terms;
- attempt to gain unauthorised access to, or disrupt, the Service or its systems;
- reverse engineer, resell or copy the Service except as permitted by law;
- upload content that is unlawful, infringing or malicious.
6. Your content
You retain ownership of the project data and content you create. You grant us a limited licence to host and process that content solely to provide the Service. You are responsible for the accuracy of any data you enter and for any decisions made on the basis of the visual output.
7. Intellectual property
The Service, including its software, design and content (excluding your content), is owned by CDM Marketing Ltd and its licensors and is protected by intellectual property laws.
8. Limitations and disclaimer
The Service is provided “as is”. AsbestoPlan is not HSE-approved or compliance certified. Final enclosure design, risk assessment, method statement, plan of work and statutory compliance remain the responsibility of competent asbestos professionals and, where required, licensed asbestos contractors. To the fullest extent permitted by law, we exclude liability for indirect or consequential losses, and our total liability arising from the Service is limited to the fees you paid in the 12 months before the claim. Nothing in these Terms limits liability that cannot lawfully be limited (such as for death or personal injury caused by negligence, or fraud).
9. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms. You may stop using the Service and delete your account at any time from your Account & privacy page.
10. Changes
We may update these Terms as the product evolves. We will update the date above and, where changes are material, notify you. Continued use after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction, save that consumers may benefit from mandatory protections of their country of residence.
